Booking Conditions for Reservations

Booking Conditions

1. Your booking may only be used for vacation purposes. The property must not be used for gatherings, such as weddings or parties, or for business purposes, except by prior written special arrangement.

2. The property will not be available before 4pm on the first day of your booking and we require that you depart by 10am on your last day to allow our housekeepers ample time to prepare the property for the next guest. Occasionally it may be possible to accommodate an early check in or a late check out, but that request must be made in advance.

3. Excluding babies in cribs, the number of people occupying the property must not exceed the number listed for the property. You may invite additional guests to visit during your stay, however they must not stay overnight.

4. Guests shall be subject to all local noise, occupancy, zoning, or other regulations of the municipality in which the occupied property is located. No camping is permitted at any of our properties.

5. No open fires of any kind are permitted inside buildings or on the property under any circumstances at any time. These include but are not limited to candles, fireworks, Chinese lanterns, and fire pits. All of our properties are non-smoking. 

6. Be advised that our properties are equipped with exterior security cameras to protect our property and ensure that our rental policies are upheld.

Pet Policy

7. The Sugarhouse and Amos Brown House allow up to a total of 2 dogs. No other pets are permitted. You must let us know at the time of your booking if you will be bringing dogs. All other properties (Naulakha, Carriage House, Stable, Dutton Farmhouse) do not allow pets. If a pet other than a dog or more than 2 dogs are brought to The Sugarhouse or Amos Brown House, or if pets are brought to Naulakha, the Carriage House, Stable, or Dutton Farmhouse, your reservation will be terminated immediately and you will be charged a $500 penalty.

8. Service animals, as defined under titles II and III of the Americans with Disabilities Act, are dogs that are individually trained to do work or perform tasks for people with disabilities.  Service animals are allowed at all properties, but The Landmark Trust USA must be given notice prior to the guest’s arrival.  Staff, at their discretion, may ask 1) is the dog a service animal required because of a disability (2) what work or task has the dog been trained to perform. Emotional support animals are not allowed at properties aside from the regular 2 dogs allowed at The Sugarhouse and Amos Brown House.

Contract & Warranties

9. Once we have accepted your booking and payment, a contract will be entered into which includes these conditions. Payment of all required amounts when they are due is a requirement under the contract and if payment is not made, your booking will be canceled.

10. When you make a booking you warrant that you are over 18 years old and accept full responsibility for all persons who will use the property during the period booked, and that you have read and understand the Terms and Conditions.

Bookings

11. Provisional bookings made by telephone will remain firm provided we receive the amount due within 24 hours unless other agreed upon arrangements have been made with The Landmark Trust USA. Please note that any provisional bookings made by email need to be confirmed over the telephone.

12. If your reservation starts within 90 days of the date you make your booking, you are required to pay the total price at the time of booking. If your reservation starts more than 90 days from the date you make the booking, you are required to pay a deposit of 1/3 of the cost of your reservation at the time of booking. If you pay a deposit, the balance must be received at least 90 days before your reservation begins. We will try to remind you of this, but if we do not receive the balance when due, we shall, with regret, cancel your booking and your deposit will be forfeited.

13. Please note: the deposit secures only the reservation dates and not the price. In some cases, prices may change. The price will not change if you pay in full at the time of booking.

14. In the case of reservations for more than one week, we provide linen and towels for each successive week but will only remake beds with the new linen if you ask before your stay begins.

Payments

15. We accept Visa, MasterCard, American Express, and personal or bank check made payable to The Landmark Trust USA. If your personal check is returned to us for non-sufficient funds, we will expect you to cover the bank fee charged to us with you providing alternate payment.

Loss or Damage

16. When you book, you agree to indemnify us against all loss and damage (including unreasonably large amounts of cleaning) arising directly or indirectly to the property and its contents from any deliberate or negligent act or omission by yourself, or any person or animal accompanying you, and, without limitation of the foregoing to pay us forthwith upon written demand our costs in making good any such loss and damage and cleaning.

17. We shall not be responsible for any loss, or damage to any belongings, or injuries sustained by you or any member of your party on our properties.

Penalties

18. Unless stated differently elsewhere in this Terms & Conditions document, violation of any terms in this document will result in penalties up to and including termination of the reservation and a $500 fee. If we need to hire an attorney as a result of your violation, you will also be responsible to reimburse us for our reasonable attorney’s fees incurred.

Access

19. Anyone we authorize may have access to any part of our properties at any time during your stay. This is unlikely to happen, but if it does, we will give you as much notice as possible. There will be no need for you to remain in the property, since one of our staff will accompany the visitor.

Cancellation Policy

20. As a nonprofit, it is challenging to refund money. Occasionally, for extenuating circumstances we may consider rescheduling your stay or holding a credit for a future stay. The Landmark Trust USA cannot be held responsible for issues related to inclement weather or natural disasters. All decisions concerning your booking are at the discretion of The Landmark Trust USA.

21. If you cancel a booking for any reason, you must notify us in writing or by email. Your deposit is non-refundable and the following cancellation charges will apply: 

●  90 days or more before the reservation start date: Your deposit

●  89 to 60 days before the start date: 50% of the total rental

●  59 to 30 days before the start date: 75% of the total rental

●  29 days before the start date or later, including early departure: 100% of the total rental

In addition, you will be responsible for any travel costs incurred by you in relation to the booking. We do not offer cancellation insurance and strongly recommend that you have your own coverage.

22. If you have any issues concerning the property during your stay, you should notify the Operations Manager (whose name and telephone number appear in the “Welcome Email” sent the week before your arrival and in the Information and Advice folder in each property) as soon as possible. The Landmark Trust USA will not normally make any refunds in respect to complaints made after the guest's departure from the property if the guest did not make the complaint or problem known during the stay. In considering any complaint we will consider whether we have been given the opportunity to investigate it and the chance to resolve the complaint.

23. We can in some cases transfer bookings to a new date for a charge of $75.00 for each booking, plus any additional rent, provided that is requested change is no fewer than 90 days before the start of the reservation. If there is a surplus we will hold that against a future booking but will not refund it.

24. We may cancel a booking at any time before the date on which it begins. We would expect to do this only for essential building work or for some other reason unforeseen by us at the time your booking was accepted. In this unlikely event we shall refund in full all money received by us for the booking but will not have any liability beyond this, and, without limitation of the foregoing, we will not have any liability for travel costs incurred by you in relation to the booking.

25. We accept no liability for any works or activity of any sort occurring on any premises adjoining or neighboring our property, nor shall we be responsible for making any inquiries about the likelihood of, or providing any information to you about, any such works or activity.
